1. Introduction
Welcome to Najila Sport ("Najila", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our website (the "Website"), our mobile or social commerce channels, customer-service interactions, and the purchase of our products and services (together, the "Services"). By using the website or placing an order, you agree to be bound by these Terms, our Privacy Policy, and any policies referenced in them, all of which are incorporated by reference. If you do not agree, you must discontinue use of the website and refrain from placing an order.
We may update these Terms from time to time. The version of the Terms in force at the time you submit an order will govern that order. Material changes will be posted on the Website with an updated "Last updated" date and, where reasonably practicable, notified to registered customers by email. Your continued use of the Website, or the placing of any order, after changes take effect constitutes acceptance of the updated Terms. If you do not accept a change, your sole remedy is to stop using the Services.
These Terms constitute a legally binding agreement between you and Najila Sport. Please read them carefully and save or print a copy for your records. We recommend you re-read these Terms each time you place an order, as they may have changed.
2. Definitions
In these Terms, unless the context requires otherwise, the following words have the following meanings:
- "Account" means any registered customer account created on the Website.
- "Confirmation" or "Dispatch Confirmation" means the email by which we confirm that an order has been accepted and dispatched.
- "Content" means all text, images, designs, logos, graphics, video, and other material made available through the Services.
- "Customer", "you", or "your" means the person who accesses the Website or places an order.
- "Force Majeure Event" has the meaning given in the Force Majeure section.
- "Order" means a request submitted by you to purchase Products through the Website.
- "Products" means the goods offered for sale by Najila Sport through the Services.
- "Working Day" means any day other than a Friday, Saturday, or a public holiday in the United Arab Emirates.
Headings are for convenience only and do not affect interpretation. Words importing the singular include the plural and vice versa. "Including" and "in particular" are illustrative and do not limit the words that precede them.
3. Eligibility and Customer Warranties
To use the website and place an order, you must be at least 18 years old, legally able to enter into binding contracts, and using a valid payment method authorised in your name or which you are otherwise authorised to use.
By using the Services or placing an order, you represent and warrant that: (a) all information you provide is accurate, current, and complete; (b) you will keep that information up to date; (c) you are purchasing Products for lawful purposes only; and (d) your use of the Services does not violate any applicable law or regulation.
We may, at our discretion, ask you to verify your identity, age, or payment authority before accepting an order, and may refuse, suspend, or cancel access where we reasonably believe these eligibility requirements are not met. The Services are not directed at children, and we do not knowingly contract with minors.
4. Accounts and Security
You may browse the Website and place certain orders as a guest. Where you create an Account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.
You agree to notify us immediately of any unauthorised use of your Account or any other breach of security. We are not liable for any loss arising from unauthorised use of your Account where you have failed to keep your credentials secure. We may suspend or terminate an Account that we reasonably believe has been compromised, used fraudulently, or used in breach of these Terms.
5. Personal Use and Prohibition On Resale
The website and the products sold through it are intended for personal use only. We reserve the right to decline orders that appear to be for resale or commercial activity, including orders for unusual quantities, multiple orders of the same item, or orders flagged by our fraud- or bulk-purchase controls.
You may not, without our prior written consent: (a) resell, redistribute, or commercially exploit any Product; (b) use the Services on behalf of any third party in the course of a business; or (c) use automated means (including bots, scrapers, or scripts) to access the Website, monitor pricing, or place orders. We may impose quantity limits on any Product and may cancel or reduce orders that exceed those limits.
6. Product Information, Descriptions, and Colour
We take reasonable care to describe and display Products accurately. However, product images are for illustration only, and the actual colour, finish, fit, and appearance of a Product may vary due to photography, screen settings, and manufacturing tolerances. Sizing is approximate and may differ between styles.
All Products are subject to availability. We may, without liability, withdraw any Product from sale, correct errors or inaccuracies in descriptions or pricing, and change or discontinue any Product at any time. Where a Product does not match its description in a material respect, your remedies are set out in the Returns and Defective Items sections below.
7. Placing Orders and Contract Formation
When you place an order, you commit to purchasing the items at the price displayed at checkout. You will receive an email acknowledging receipt of your order; however, your order is only accepted and a binding contract is formed—only when we send you a Dispatch Confirmation for the relevant items. An acknowledgement of receipt is not an acceptance of your order. Where an order contains multiple items, a contract is formed only in respect of the items covered by each Dispatch Confirmation. We may decline an order for reasons including payment issues, stock unavailability, suspected fraud, or technical errors, suspected breach of these Terms, pricing or description errors, restrictions on delivery to your location, or where required by applicable law.
Where we decline or cancel an order before dispatch, we will not charge you, or we will refund any amount already taken, to the original payment method. We are under no obligation to accept any order and may limit or refuse orders at our discretion, acting reasonably.
You are responsible for ensuring that the details of your order, including item, size, quantity, delivery address, and contact information, are correct before you submit it. Please review your order carefully, as we begin processing promptly and cannot always amend an order after submission.
8. Stock Availability
Items added to your cart are not reserved until the order is paid for and confirmed. If an item becomes unavailable after your order is placed, we will notify you and issue a full refund for the affected item. Where only part of an order is affected, we will fulfil the remainder and refund the unavailable item. Adding an item to your cart does not guarantee its availability, and stock levels shown on the Website are indicative only.
9. Cancellation By You And By Us
Orders may be cancelled prior to dispatch. Once an order has been shipped, it may be returned after delivery in accordance with our returns process. To cancel before dispatch, contact us as soon as possible using the details in the Contact section; we will use reasonable efforts to stop dispatch but cannot guarantee cancellation once processing has begun.
We may cancel a contract before or after dispatch if a Product is unavailable, if a pricing or description error is identified, if we suspect fraud or unauthorised payment, if delivery to your address is not feasible, or if you are in material breach of these Terms. If we cancel after payment, we will refund the amount paid for the cancelled items to the original payment method.
10. Statutory Cancellation Rights (UK Customers)
If you are a consumer in the United Kingdom, you may have a statutory right to cancel a distance-purchase contract within 14 days of receiving your Products, for any reason, in addition to our voluntary returns policy below. To exercise this right, you must inform us of your decision by a clear statement before the period expires.
Where you cancel under this right, you must return the Products without undue delay and within 14 days of notifying us, and we will reimburse the price and standard delivery cost within 14 days of receiving the Products back or of receiving evidence that you have returned them. We may withhold reimbursement, or reduce it, to reflect any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the Products. Certain items may be excluded from this right where permitted by law, including sealed hygiene items that have been unsealed. This section does not affect your other statutory rights.
11. Prices, Taxes, And Pricing Errors
All prices are displayed in AED and exclude delivery fees, which are shown at checkout. Unless stated otherwise, prices are inclusive of any value added tax (VAT) applicable in the United Arab Emirates. For international orders, prices may exclude duties and import taxes, which are addressed in the Shipping section. If a pricing error occurs, we may contact you to confirm the correct price or cancel the order. If an order has already been processed at an incorrect price, we reserve the right to cancel and refund it, except that where the correct price is higher and the error is obvious and could reasonably have been recognised by you as a mispricing, we are not obliged to supply the Product at the incorrect lower price.
Prices, promotions, and delivery charges may change at any time, but changes will not affect orders for which we have already sent a Dispatch Confirmation. We make reasonable efforts to ensure prices are accurate, but errors may occur.
12. Promotions, Discount Codes, And Gift Cards
Promotions and discount codes are subject to availability, may be withdrawn or amended at any time, are valid only for the stated period, cannot be used in conjunction with other offers unless expressly stated, and have no cash value. Each code may be limited to one use per customer or Account and may exclude certain Products.
We reserve the right to cancel orders, void discounts, and decline future orders where we reasonably believe a code has been obtained, used, or shared in breach of its terms or in a manner involving fraud or abuse. Gift cards, where offered, are non-refundable, cannot be exchanged for cash, and are valid only for the period and on the terms stated at the time of purchase.
13. Payment, Fraud Screening, And Chargebacks
We currently accept Visa, Mastercard, American Express, Apple Pay, Tabby, and Mamo. By submitting payment information, you confirm that you are authorised to use the selected payment method. Refunds will always be issued to the original payment method, except where that method is no longer valid, in which case we will agree an alternative method with you.
Payments are processed by third-party payment providers, and your use of their services may be subject to their own terms and privacy practices. Buy-now-pay-later and instalment options (such as Tabby) and wallet services (such as Mamo) are provided by those third parties, who assess and approve eligibility; we are not responsible for their decisions, fees, or interest charges.
We may carry out fraud, sanctions, and identity checks before accepting or dispatching an order and may decline or cancel orders that fail these checks. Payment is taken or authorised at the time of order; where payment is only authorised, we capture funds on or before dispatch. You agree not to initiate a chargeback or payment dispute without first contacting us to resolve the matter. We reserve the right to recover sums, suspend Accounts, and pursue available remedies in respect of fraudulent transactions or unjustified chargebacks.
14. Shipping, Delivery, Risk, And Title
14.1 UAE Delivery
Orders placed before 2:00 PM (Dubai time) are eligible for same‑day delivery within Dubai. Orders placed after this cut‑off will be delivered the next day. Delivery to other Emirates typically requires 1–2 working days. Delivery timelines are estimates and may vary during weekends, public holidays, or peak periods. If the courier is unable to reach you after reasonable attempts, the order may be returned to us and refunded. Same-day eligibility is also subject to successful payment, stock availability, and the order clearing our fraud checks before the cut-off.
14.2 UK Delivery
We offer international delivery to the United Kingdom. Orders typically arrive within 3–5 working days. Any customs duties or import taxes applicable upon arrival are the responsibility of the customer. Delivery estimates exclude time held in customs. You are the importer of record for international orders and are responsible for ensuring the Products may lawfully be imported into the destination country.
14.3 Delivery Information, Risk, and Title
You are responsible for providing accurate and complete delivery and contact details. We are not liable for delays or failed deliveries caused by incorrect or incomplete information that you have provided, by your absence, or by a refusal to accept delivery.
Risk of loss or damage to the Products passes to you on delivery to the address you provide or to a person identified by you as authorised to take delivery. Title to the Products passes to you only when we have received payment in full. Where a delivery is unsuccessful after reasonable attempts and the Products are returned to us, we will refund the price of the Products but may deduct the cost of failed or return carriage where the failure was attributable to you.
15. Returns Process
We offer a 30‑day return window from the date of delivery. Returned items must be unworn, unwashed, in original condition, free from marks or damage, and with all tags intact. Items must be returned with their original packaging. Returns that do not meet these conditions may not be accepted and may be returned to you at your cost, or, where collection is not arranged within a reasonable period, dealt with in accordance with applicable law.
To start a return, contact us using the details in the Contact section to obtain return instructions before sending any item back. Items returned without prior authorisation may be delayed or refused. Unless an item is defective or incorrectly supplied, you are responsible for the cost and risk of return carriage until the item is received by us; we recommend using a tracked service and retaining proof of postage.
15.1 Defective or Incorrect Items
If an item arrives damaged or defective, we will offer a replacement where available or issue a full refund to the original payment method. Please notify us promptly, and in any event within a reasonable period of discovering the defect, providing your order number and supporting photographs where possible. Where an item is defective, incorrect, or not as described, we will cover the cost of return carriage. This section does not affect your statutory rights.
15.2 Non-Returnable Items
For hygiene reasons, certain items such as underwear, socks, or items marked "non‑returnable" at checkout cannot be returned once any hygiene seal has been broken, except where the item is defective or your statutory rights provide otherwise. Final-sale or clearance items, and personalised or made-to-order items, may also be non-returnable where clearly marked at the point of sale.
15.3 Exchanges
Exchanges are offered subject to stock availability. If your preferred replacement is unavailable, we will process a refund in accordance with the Refunds section. Any difference in price between the original and replacement Product will be charged or refunded as applicable.
16. Refunds
Once a returned item is received and approved, refunds will be issued to the original payment method. Najila requires 3–5 business days to process the refund; bank processing times may vary. Where a return does not meet our conditions, we will contact you before declining the refund. Original delivery charges are non-refundable except where the item is defective, incorrect, not as described, or where you exercise a statutory cancellation right, in which case standard delivery costs are refundable as required by law.
17. Reviews And User Content
If you submit reviews, comments, images, or other material through the Services ("User Content"), you grant Najila Sport a non-exclusive, royalty-free, worldwide, sub-licensable licence to use, reproduce, adapt, publish, and display that User Content in connection with the Services and our marketing, for the duration permitted by applicable law.
You represent that you own or have the necessary rights to your User Content, that it is accurate, and that it does not infringe any third-party rights or any law. You must not submit content that is unlawful, defamatory, obscene, misleading, or that contains personal data of others without consent. We may, but are not obliged to, moderate, edit, or remove User Content at our discretion, and we may remove content following a good-faith complaint of infringement.
18. Intellectual Property
All content on the Najila Sport website, including images, designs, logos, and text, is owned by Najila Sport or its licensors and is protected by intellectual property laws. The Najila Sport name and logo are trademarks of Najila Sport. Content may not be used without prior written permission.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for your personal, non-commercial use in accordance with these Terms. You must not copy, reproduce, modify, distribute, scrape, frame, or create derivative works from any part of the Services except as expressly permitted. All rights not expressly granted are reserved.
If you believe that content on the Website infringes your intellectual property rights, please contact us with details sufficient to identify the content and your rights, and we will review and respond in accordance with applicable law.
19. Acceptable Use

The Services are provided on an "as available" basis. While we take reasonable care to keep the Website available and the information on it accurate, we do not warrant that the Website will be uninterrupted, error-free, secure, or free from viruses, or that defects will be corrected.
Except as expressly set out in these Terms, and save for any warranties, conditions, and rights implied by law that cannot lawfully be excluded, all warranties, conditions, and other terms implied by statute or common law are excluded to the fullest extent permitted by law. Nothing in these Terms affects a consumer’s mandatory statutory rights.
21. Limitation Of Liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
We are not liable for courier delays, incorrect delivery information provided by the customer, or damage resulting from misuse of products. Our liability is limited to the value of the order giving rise to the claim. Subject to the paragraph above and to any mandatory consumer rights, we are not liable for any indirect, incidental, special, or consequential loss, or for loss of profit, revenue, goodwill, data, or anticipated savings, whether arising in contract, tort (including negligence), or otherwise, even if foreseeable.
Where you are a consumer, these Terms do not limit liability for foreseeable loss caused by our failure to use reasonable care and skill, and we are responsible for loss that is a foreseeable result of our breach. We are not responsible for any loss arising from your failure to follow reasonable instructions or from events outside our reasonable control.
22. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Najila Sport, its officers, employees, and agents from and against any claims, losses, liabilities, and reasonable costs (including legal fees) arising out of your breach of these Terms, your misuse of the Services, your User Content, or your violation of any law or third-party right. This section does not apply to the extent a loss results from our own breach, negligence, or wilful misconduct.
23. Force Majeure
We are not liable for any failure or delay in performing our obligations where caused by events outside our reasonable control (a "Force Majeure Event"), including acts of God, severe weather, fire, flood, epidemic or pandemic, war, civil unrest, government action, strikes, failures of utilities, carriers, payment networks, or telecommunications, and supply-chain disruption. Where a Force Majeure Event affects performance, we will notify you and our obligations will be suspended for the duration of the event; if it continues for an extended period, either party may cancel the affected order and we will refund sums paid for undelivered Products.
24. Suspension And Termination
We may suspend, restrict, or terminate your access to the Services, or close your Account, where we reasonably believe you have breached these Terms, engaged in fraud or abuse, or where required by law. Termination does not affect any accrued rights or liabilities, or any provision intended to survive termination, including those relating to intellectual property, liability, indemnity, and governing law.
25. Privacy And Data Protection
We process personal data in accordance with our Privacy Policy and applicable data-protection laws, including the UAE Personal Data Protection Law and, for UK customers, the UK GDPR and Data Protection Act 2018. By using the Services, you acknowledge that we collect and process your data as described in our Privacy Policy. Where we rely on third-party processors (including payment and delivery providers), we take reasonable steps to ensure appropriate safeguards are in place.

The Website may contain links to third-party websites or services that are not operated by us. We provide these links for convenience only and do not endorse or accept responsibility for third-party content, products, or practices. Your use of third-party websites and services is at your own risk and subject to their terms.

These Terms, together with the documents referred to in them, constitute the entire agreement between you and us in relation to their subject matter and supersede any prior agreement or understanding. You acknowledge that you have not relied on any statement or representation not set out in these Terms.
28.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary or, if it cannot be modified, severed, and the remaining provisions will continue in full force and effect.
28.3 Waiver
A failure or delay by us in exercising any right or remedy under these Terms does not constitute a waiver of that or any other right or remedy, and no single or partial exercise prevents any further exercise.

These Terms are governed by the laws of the United Arab Emirates. Any disputes will be subject to the exclusive jurisdiction of UAE courts, in particular the courts of the Emirate of Dubai. Nothing in this section deprives a consumer of the protection of any mandatory consumer-protection laws of the country in which they are habitually resident, and consumers in the United Kingdom may, where applicable, bring proceedings in their local courts and benefit from mandatory provisions of the law of their place of residence.
